Before Hiring an Estate Planning Attorney, Understand The Difference

Many estate planning attorneys take a “one-size-fits-all” approach with their clients. They do this so that they can work with as many people as possible in a short period of time.

The problem is that the client has an impersonal experience, and worse than that, this way of planning can lead to unintended results in the long run for the family.

When lawyers do not take the time to listen and consider your personal circumstances, the result is that your estate plan (typically not really a “plan” but simply a set of documents) does not end up reflecting what you and your family really want to happen or might think will happen.

And usually there is no regular plan review or updating that your attorney is doing for you, so your plan quickly becomes outdated and does not work when your family needs it most.

4. We help you make sure your assets are titled correctly. 

If your plan is done, but your assets aren’t titled correctly, your plan still may not work as intended.  We provide instructions on how to title different assets.  We can also do trust funding for you by request.

We provide an asset spreadsheet for all of our trust clients to make sure your family knows what assets you have, where they are located and how they are titled.  We review this spreadsheet as part of our three-year review process and provide instructions on how to title these accounts.   

6. Special Planning for minor children.  

If you have minor children, we make sure you have not only named guardians, but have also named short-term guardians and have provided instructions for the child’s medical care, financial management and child raising.  We make sure your children are never raised by anyone you wouldn’t want or taken into the care of strangers. If your children are adults, we help you weave them into your estate plan with care and forethought. 

7. We specialize in legacy planning because it’s about more than money. 

We believe that planning is about much more than the transfer of your financial wealth. For each client, we walk you through a process to help you transfer your most important personal wealth to your loved ones, including your intellectual, spiritual and human assets – who you are and what’s important to you.

We know the consequences of your choices in planning because we do post-death trust administration and probate.  We help you make informed choices, and if you lose a family member and need help administering their estate, we can help walk you through that process as well.
